The Person Won't Accept Service. What's Next? Substituted Service & Diligent Search Explained

California Process Servers · August 23, 2026

When the defendant avoids service, learn about diligent search and substituted service: California's solution for hard-to-reach people.

It's the plot device in every legal drama: the defendant is *avoiding service*. They see the process server coming, don't answer the door, or leave town. Your case is stalled because you can't serve them. And you're frustrated.

This isn't as much of a dead end as it feels. California law has solutions: diligent search and substituted service. Here's how they work and why they matter to your case.

## When Personal Service Doesn't Work

Personal service (handing papers directly to the person being sued) is the ideal outcome. It's clean, it's certain, and it's hard to challenge in court.

But sometimes it's impossible. The person:

- Won't answer the door when the server knocks - Has moved and left no forwarding address - Is deliberately hiding or evading service - Works irregular hours and is never home - Uses a home security system to screen visitors

When that happens, California allows alternatives; but not just any shortcut will do. The law requires *diligent search* first, then *substituted service* as a backup.

## What "Diligent Search" Really Means

Diligent search is exactly what it sounds like: a thorough, documented effort to find the person and serve them properly.

Before any alternatives are used, the process server must:

- Visit the address multiple times on different days and at different times - Speak with neighbors, building managers, or occupants about the person's whereabouts - Check for mail or other indicators the person still lives there - Research public records, social media, employment databases, and other sources - Document every attempt with dates, times, people spoken to, and results - Keep trying across a reasonable time period (typically several weeks)

All of this is recorded and included in the proof of service. The court needs to see that you didn't just give up after one knock on the door.

**What a thorough diligent search might uncover:** - The person moved six months ago (neighbor confirms) - Mail is still being delivered there (may indicate hiding in place) - A family member visits the address on weekends (suggests person still connected to location) - Employment records show a workplace address (alternative location to try) - Social media posts geotagged to a different city (hint they've relocated) - Utility company confirms the person's name is still on the account - A registered vehicle is parked at a nearby residence (might be a hiding spot)

## Substituted Service: The Legal Alternative

Once diligent search shows the person can't be located for personal service, California allows substituted service: delivering papers to someone *other than* the intended recipient.

Substituted service might mean:

**At the Person's Home:** Leaving papers with an adult household member (spouse, adult child, roommate, live-in employee) who's at least 18 years old.

**At the Person's Workplace:** Handing papers to an office manager, a person in authority at the business, or an adult colleague if the server can confirm the papers will reach the defendant.

**Service by Mail:** Mailing papers to the last known address, sometimes with additional publication (posted notices), as a last resort.

Each method has specific California legal requirements. Service is only valid if the substituted recipient is likely to deliver the papers to the intended person, and the process server must prove they tried personal service first through diligent search.

## Why This Matters for Your Case

If substituted service is done improperly, the defendant can later claim they never actually received notice of the case. The case can be delayed, and in some cases, thrown out.

The difference between proper and improper substituted service often comes down to documentation:

- Did the process server actually make multiple attempts at personal service? - Was there true diligent search, or just one or two quick knocks? - Was the substituted recipient someone likely to pass papers to the defendant? - Are there timestamps and witness confirmations?

A professional process server builds an iron-clad record that answers all of these questions.

## When to Contact a Professional

If you're attempting service yourself and it's not working, or if you're unsure whether substituted service is appropriate for your situation, it's time to bring in a professional.

California Process Servers has the expertise to conduct thorough diligent search, determine the right method of substituted service for your case, and document everything in a way that holds up in court. ## Don't Let Service Failures Delay Your Case

Diligent search and substituted service exist so cases don't stall when people try to hide. But the process is detail-heavy and easy to mess up on your own. California Process Servers handles it all: the search, the documentation, the filing. Your case keeps moving.
