Terms of Service

Effective Date: September 22, 2026

Welcome to California Process Servers ("we," "us," "our"). By using our website or submitting our intake form, you agree to the following Terms of Service.

1. Services

California Process Servers provides process serving and related legal document delivery services within California. Submission of the intake form constitutes a request for service and does not guarantee successful service of process, which depends on factors outside our control (e.g., defendant availability, address accuracy).

Service is never guaranteed, but we make every diligent attempt to serve on every job.

2. Turnaround Times

  • Routine service: first attempt typically within 3–4 days after the job is assigned to a server
  • Restraining orders and evictions always require Rush service
  • Any order due 8 days or less from submission requires Rush service
  • Rush service: same-day priority if received before 12:00 PM on a business day (subject to server availability), otherwise typically 1–2 days after assignment
  • Orders received on a weekend or court holiday are sent to a process server the next business day. Turnaround is counted from the day the server receives the job, and attempts may be made on any day, including evenings and weekends.
  • Proof of service is typically returned 2–3 business days after service is completed
  • Court filing timelines depend on the applicable court's processing schedule

Timelines are estimates, not guarantees, and may vary based on server availability and case circumstances.

3. Communications Consent (SMS, Email, Phone)

By submitting the intake form and providing your phone number, you expressly consent to receive communications from California Process Servers via phone call, email, and SMS/text message regarding your service request, including status updates, scheduling, and document delivery.

  • Message frequency varies based on your case activity.
  • Message and data rates may apply.
  • You may opt out of SMS at any time by replying STOP. Reply HELP for assistance.
  • Consent to receive SMS messages is not a condition of purchasing any services, except where SMS is the selected method of receiving required case updates.

See our Privacy Policy for full details on how your information is used.

4. Client Responsibilities

You agree to provide accurate information regarding the person to be served, including name, address, and any relevant details that may assist in completing service. Inaccurate information may delay or prevent service and additional fees may apply for re-attempts.

Each order is attempted at the address you provide. We are not responsible when service is delayed, unsuccessful, or completed at the wrong location because the address you provided was incorrect, incomplete, outdated, or otherwise unsuitable for service.

You are also responsible for providing the complete and correct documents you want served. We do not determine which documents your matter requires, and we are not responsible for serving incorrect or incomplete documents supplied by you.

5. Fees & Payment

Fees are based on the service level selected (routine, rush, etc.) and are due as outlined at the time of order. Additional attempts, stakeouts, or skip tracing services may incur additional charges, communicated to you in advance where possible.

Service is not attempted until payment is received. For urgent matters, contact our office to arrange payment promptly so service can be attempted right away.

Fees are quoted per defendant, per address. An additional address or additional defendant is quoted as an additional fee.

6. No Legal Advice

California Process Servers and its process servers are not attorneys and cannot give legal advice. We cannot tell you which documents to serve, how to prepare them, or what legal steps to take. Please consult a qualified attorney if you need guidance about your legal matter.

7. Limitation of Liability

We are not liable for delays or failures in service caused by factors outside our reasonable control, including but not limited to inaccurate information provided by the client, an incorrect or unsuitable service address, incorrect or incomplete documents supplied by the client, evasive defendants, or court processing delays. Our liability for any claim is limited to the amount paid for the specific service in question.

8. Governing Law

These Terms are governed by the laws of the State of California.
